Iraq is open for business and investors are lining up. Major infrastructure projects are springing up all over Iraq, as the country is recovering from decades of war, sanctions, and domestic unrest. There is a dire need for an array of infrastructure investments – particularly, in the areas of healthcare, housing, power, water, manufacturing, transportation, and telecommunications. Construction projects are being launched throughout Iraq, even in the most remote areas, for which significant foreign investment will be needed. Public entities in Iraq are finding it difficult to provide the large amount of funds and resources needed for these infrastructure projects and, as a result, foreign investors are expected to become important financiers.
But should a prudent foreign investor consider financing such projects? Under the current Iraqi investment law, there are several options available to foreign investors depending on the business needs and activities to be exercised in Iraq. However, the political reality seems to be a major discourager, perhaps only to those who do not perceive risk as opportunity.
Incentivising Foreign Capital
In 2006, Iraq enacted several investment laws at the federal, regional and governorate level in order to stimulate investment and development of infrastructure projects. These laws also aim at encouraging Iraqi and foreign private sectors to invest in Iraq, to create employment opportunities for Iraqis as well as to improve the balance of payments.
Investment Law No. 13 of 2006
Investment Law No. 13 of 2006 (the “Investment Law”) provides investment incentives and establishes the National Investment Commission (“NIC”) with the authority to grant investment licenses for projects determined to be of national and strategic importance. The purpose of the NIC is to serve as a single point of contact for investors who are interested to invest in Iraq. The remit of the NIC is to facilitate investment in strategic projects which include (a) projects of capital not less than USD 250,000; (b) projects related to the extraction of natural resources (excluding oil and gas); (c) projects arising from an agreement where the Republic of Iraq is a party therein; (d) petrochemical, pharmaceutical, or industry projects, involving the manufacture and production of vehicles; (e) transportation projects (roads, ports, airports, etc.); and (f) electricity projects of production capacity not less than 30 megawatts. Notably, projects with a minimum capital USD 1 billion are generally considered as strategically important by the NIC.

US Treasury Secretary Timothy Geithner will travel to India this month for annual economic discussions aimed at expanding bilateral trade and economic ties, the Treasury said Tuesday.
Geithner will meet with Indian Finance Minister Pranab Mukherjee in Delhi on June 27 for the third ministerial meeting of the US-India Economic and Financial Partnership.
Geithner "will also discuss issues related to illicit finance, including the implementation of international sanctions," the Treasury said in a statement.
Geithner and Mukherjee have led the cabinet-level meetings, which are alternately held in the United States and India.
The bilateral discussion over the past three years have focused on macroeconomic policy, the financial sector, and infrastructure financing in a bid to build cooperation between two of the world's largest economies.

US exempts India, but not China, from Iran sanctions
The United States said it would exempt seven emerging economies including India from tough new sanctions after they cut back on oil from Iran, but the punishment still loomed for China.
Secretary of State Hillary Clinton added India, Malaysia, South Africa, South Korea, Sri Lanka, Turkey and Taiwan to the list of those exempt from the sanctions. In March, she made exemptions for European Union nations and Japan.
The decision was announced two days before Clinton meets Indian officials for annual talks. The move resolves one of the biggest points of tension in years in the growing relationship between the world's two largest democracies.
Under a law approved last year that irritated some US allies, the United States starting on June 28 will penalize foreign financial institutions over transactions with Iran's central bank, which handles sales of the country's key export.
Clinton said the seven economies exempted on Monday have all "significantly" reduced crude oil purchases from Iran. She cast the exemptions as proof of success in the US campaign to put pressure on Iran's clerical regime, which Israel and some Western officials fear is seeking a nuclear bomb.

Erbil, The Council of Ministers has approved the recommendation of the energy committee to authorize the Minister of Oil to sign a memorandum of understanding between the Iraq's Ministry of Oil and the Ministry of Energy and Mineral Resources in Jordan in the areas of oil and energy.
The agreement is for a five year period and includes the construction of a pipeline to transport crude oil and natural gas through Jordanian territory.
Iraqi government spokesman Ali al-Dabbagh said in a statement today: "The recommendation of the energy committee about the memorandum of understanding between Iraq and Jordan shows the keenness of the Iraqi government to develop a clear and appropriate action mechanism to promote cooperation between the two sides in the areas of oil and gas, as Iraq has large reserves of crude oil and natural gas that meet the local demand and export the surplus, in light of the growing need of Jordan to import these materials to support its development plans and meet its needs.
